Juan Martinez is a Partner based in our New York Office. Mr. Martinez represents state attorneys general and public entities in litigation and investigations, whistleblowers in federal and state false claim actions, and consumers in complex class action matters.
Prior to joining Kirby McInerney, Mr. Martinez practiced at a prominent national law firm in its Public Clients and Whistleblower practice groups. Previously, he worked for several multinational law firms, where he focused his practice on government investigations and enforcement actions as well as products liability litigation with an emphasis on pharmaceutical, medical device, and health care litigation. He has experience litigating a variety of complex matters in both state and federal courts, including multidistrict litigation.
Before attending law school, Mr. Martinez served in the United States Army and was also a member of the U.S. intelligence community.

Experience
- Representation of the Commonwealth of Kentucky and other municipalities against manufacturers, distributors, and dispensers of opioids.
- Served as a Special Assistant Attorney General for the State of Kansas in a Commodities Exchange Act investigation and litigation.
- Representation of the States of Montana and Iowa in litigation against Big Tobacco companies related to defendants’ wrongful withholding of funds due as part of their payment obligations under the 1998 Master Settlement Agreement.
- Representation of clients in whistleblower matters under the False Claims Act and before regulatory agencies, such as the Securities and Exchange Commission. This includes vetting potential cases through investigations, preparing documents responding to inquiries from government investigations conducted by the Department of Justice, Securities and Exchange Commission, and Offices of Inspector General from federal agencies.
- Mr. Martinez was a member of the Plaintiffs’ Steering Committee for Insulin Pricing Litigation, 2:23-md-3080 (MDL 3080) (D.N.J.).
